1993 LAWS OF MARYLAND

(II) THE FUNDING PROVIDED BY THE DEPARTMENT IN ITS
ANNUAL BUDGET FOR THE MOTORCYCLE SAFETY PROGRAM SHALL BE EQUAL TO
OR GREATER THAN THE LEVEL OF FUNDING FOR THE MOTORCYCLE SAFETY
PROGRAM IN FISCAL YEAR 1992 AS APPROVED BY THE GENERAL ASSEMBLY.

(III) The Administration may reimburse a motorcycle safety training
center at a rate established by the Administration for each eligible person completing the
course. The reimbursement rate may be in addition to the assistance provided under
subsection (d) (A) of this section.

(2)     The funds provided under this section shall be in addition to any other
State aid.

(3)     The Administration shall MAY not contract for the provision of any
services under this program the aggregate costs of which exceed the funds credited to
APPROPRIATED FOR the Motorcycle Safety Program Account in the Transportation Trust
Fund
.

(4) THE ADMINISTRATION SHALL RECOVER THE FULL COSTS OF
OPERATING THE PROGRAM FROM ANY MISCELLANEOUS FEES AS DEFINED IN § 12-120(A)
OF THIS ARTICLE.

SECTION 3. AND BE IT FURTHER ENACTED, That the Laws of Maryland read
as follows:

Chapter 269 of the Acts of 1992

[SECTION 19. AND BE IT FURTHER ENACTED, That, notwithstanding any
other provision of law, for Fiscal Year 1993 only:

(a)     The State Secretary of Transportation shall transfer to the account of the
Department of Transportation in the Transportation Trust Fund as established under §
3-216 of the Transportation Article, any funds in the Motorcycle Safety Program Account
as established under § 16-605 of the Transportation Article that are not required to
operate the Motorcycle Safety Program after March 15, 1993 in accordance with the
provisions of the Fiscal Year 1993 Budget Bill.

(b)     The funds transferred to the account of the Department of Transportation in
accordance with the provisions of subsection (a) of this section shall be used for any
lawful purpose of the Department, other than to subsidize motorcycle driver training.]

SECTION 2. AND BE IT FURTHER ENACTED, That, notwithstanding any
other provision of law, any funds that were transferred in accordance with the provisions
of Chapter 269 of the Acts of the General Assembly of 1992 from the Motorcycle Saf
ety
Program Account, as established under § 16-605 of the Transportation Article, shall be
transferred back to the Motorcycle Safety Program Account.

SECTION 4. AND BE IT FURTHER ENACTED, That, notwithstanding any other
provision of law:
