16-605.
(a) There is a Motorcycle Safety Program Account in the Transportation Trust
Fund.
]-(b) There shall be deposited in the Motorcycle Safety Program Account, and
disbursed in accordance with this section, the following:
(1) $5.00 for each annual motorcycle registration fee collected under §
13-915(b) of this article; and
(2) $22 of each fee collected for issuance of now Class M drivers' licenses
under § 16-111.1(a) of this article.
(c) (1) All revenue collected annually under this section and retained by the
Department shall be applied to the Motorcycle Safety Program Account of the
Transportation Trust Fund and shall be used solely for the Motorcycle Safety Program.
(2) Any unused funds shall be retained at the end of each fiscal year in the
Motorcycle Safety Program Account for use during subsequent years.
(d) (1) The Administration may award contracts out of the appropriation to the
Department from the funds available in FOR the Motorcycle Safety Program Account to
qualifying motorcycle safety training centers for the conduct of approved motorcycle
safety courses. These contracts may provide funding, equipment, and materials to
establish and maintain the training centers.
(2) The Administration may award contracts in accordance with Division II
of the State Finance and Procurement Article out of the appropriation to the Department
from the funds available in FOR the Motorcycle Safety Program Account for the
procurement of services and products to be used to achieve the purpose of the Motorcycle
Safety Program.
(e) (1) (I) [From] NOTWITHSTANDING ANY OTHER PROVISION OF LAW,
IN FISCAL YEAR 1994 AND EVERY YEAR THEREAFTER, FROM the funds available in the
Motorcycle Safety Program Account of the Transportation Trust Fund, the Department
shall provide funds in its annual budget that will be sufficient to fund the costs incurred
in the implementation and operation of activities under this subtitle, including
administrative costs.
(B) (1) FROM THE FUNDS APPROPRIATED FOR THE MOTORCYCLE SAFETY
PROGRAM, THE DEPARTMENT SHALL FUND THE COSTS INCURRED IN THE
IMPLEMENTATION AND OPERATION OF ACTIVITIES UNDER THIS SUBTITLE, INCLUDING
ADMINISTRATIVE COSTS.
(II) THE LEVEL OF FUNDING MAINTAINED IN THE ACCOUNT AT
ALL TIMES SHALL BE SUFFICIENT TO PROVIDE THE KIND AND NUMBER OF
PROGRAMS PROVIDED UNDER THIS SUBTITLE BEFORE FISCAL YEAR 1993.
