WILLIAM DONALD SCHAEFER, Governor
Ch. 3
Subsection (b) of this section is revised in standard
language that allows the Board to determine the
"times" and "places" for its meetings and hearings.
In subsection (c)(1) of this section, the word
"compensation" is substituted for the former reference
to "salary per diem", to conform to similar provisions
elsewhere in this article.
In subsection (c)(2) of this section, the former
reference to payment "out of the moneys available
therefor in the hands of the Board" is deleted as
inaccurate and obsolete. Currently, all money that
the Board collects is part of the General Fund of the
State or the Licensing Testing Fund of the Department.
Therefore, the Board does not have any "moneys" of its
own.
Also in subsection (c)(2) of this section, the words
"necessary and proper", which formerly modified the
word "expenses", and the former phrase "for travel and
otherwise" are deleted as unnecessary in light of the
reference to the Standard State Travel Regulations.
See COMAR 23.02.01.01 through 12.
In subsection (d)(1) of this section, the word "staff"
is substituted for the former reference to a
"secretary and ... clerical force", for brevity.
Also in subsection (d)(1) of this section, the power
to employ a staff "in accordance with the State
budget" is substituted for the former power to employ
and compensate staff "as from time to time in its
judgment may be necessary in the administration of
this subtitle if it has funds available for such
persons", since the State budget would control
regardless of whether the Board considers a staff
member "necessary".
Also in subsection (d)(1) of this section, the former
powers to "discharge" staff "at pleasure" and "fix the
compensation" are deleted since staff is provided
through the Department.
In subsection (d)(2) of this section, the phrase "in
the form and amount required by law" is standard
language substituted for the former incomplete
reference to Art. 78A, §§46 through 50 of the Code.
See also Art. 19, § 20 of the Code and SF §§ 9-107 and
10-203.
