LAWS OF MARYLAND

The second sentence of former Art. 56, § 466(b), which
enabled the Board to lease and maintain office space
unless the State does, is deleted as obsolete. All
office space for the Board is provided through the
Department.

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, that
the addition of 2 consumer members to the Board in
1974 substantially changed the effect of the quorum
requirement in subsection (a) of this section. As
originally formed, the Board consisted of 5 members,
and the quorum requirement of 3 members constituted a
simple majority of the membership. Ch. 584, Acts of
1974, added 1 consumer member to the Board while, in
the same year, the Governor added a second consumer
member under the provisions now codified as Art. 41, §
8-102(c) of the Code. However, a corresponding change
was not made to the quorum provision. Since it does
not seem that this omission was deliberate, the
General Assembly may wish to consider reinstating the
"simple majority" standard by providing that a
majority of the authorized membership of the Board is
a quorum.

3-205. CODE OF ETHICS.

WITH THE ADVICE OF THE ESTABLISHED ARCHITECTURE SOCIETIES,
THE BOARD SHALL ADOPT, BY REGULATION, A CODE OF ETHICS FOR
PRACTICING ARCHITECTURE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second sentence of
former Art. 56, § 466(c).

The phrase "by regulation" is substituted for the
former, incomplete reference to "procedures set forth
in the Administrative Procedure Act Governing the
Promulgation of Rules and Regulations", which- failed
to reflect other generally applicable provisions for
adoption of regulations. See Title 10, Subtitle 1 of
the State Government Article.
