(2)  TO CONDUCT A REVIEW UNDER THIS SUBSECTION, AN
APPLICANT SHALL SUBMIT A WRITTEN REQUEST TO THE BOARD WITHIN 60
DAYS AFTER THE DATE ON WHICH THE BOARD MAILS NOTICE OF THE
APPLICANT'S FAILURE.

(3)  AN APPLICANT WHO DOES NOT REQUEST REVIEW IN
ACCORDANCE WITH PARAGRAPH (2) OF THIS SUBSECTION WAIVES THE RIGHT
TO REVIEW UNDER THIS SUBSECTION.

(C)  CONFIRMATION OF SCORES.

(1)  THE BOARD SHALL CONFIRM THE TEST SCORE OF ANY
APPLICANT WHO FAILS AN EXAMINATION GIVEN UNDER THIS SUBTITLE IF
THE APPLICANT:

(I)  SUBMITS A WRITTEN REQUEST TO THE BOARD IN
ACCORDANCE WITH ITS REGULATIONS; AND

(II)  PAYS TO THE BOARD THE FEE SET BY THE
BOARD.

(2)  THE BOARD SHALL ADOPT REGULATIONS THAT SET
PROCEDURES FOR CONFIRMATION OF TEST SCORES UNDER THIS SUBSECTION.

(D)  CONFERENCE WITH BOARD MEMBER.

(1)  SUBJECT TO THIS SUBSECTION, AN APPLICANT WHO
FAILS AN EXAMINATION 3 TIMES MAY HAVE A CONFERENCE WITH A MEMBER
OF THE BOARD.

(2)  TO HAVE A CONFERENCE UNDER THIS SUBSECTION, AN
APPLICANT SHALL SUBMIT A WRITTEN REQUEST TO THE BOARD WITHIN 45
DAYS AFTER THE DATE ON WHICH THE BOARD MAILS NOTICE OF THE
APPLICANT'S 3RD FAILURE.

(3)  AN APPLICANT WHO DOES NOT REQUEST A CONFERENCE IN
ACCORDANCE WITH PARAGRAPH (2) OF THIS SUBSECTION WAIVES THE RIGHT
TO HAVE A CONFERENCE UNDER THIS SUBSECTION.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from the
references, in former Art. 75 1/2, § 14(d)(2) and (4),
to the address to which a notice of failure is to be
mailed and revised to state affirmatively that the
Board must notify applicants who fail examinations.

Subsections (b) through (d) of this section are new
language derived without substantive change from
former Art. 75 1/2, § 14(d)(2) and (4), except for the
references to addresses to which notices are to be
mailed, and the first sentence of (3).
