LAWS OF MARYLAND

The second sentence of former Art. 75 1/2, § 14(d)(3),
which stated that no review of an examination, other
than confirmation of a test score, would be provided,
is deleted as erroneous in light of subsections (b)
and (d) of this section.

14-309. SAME -- REEXAMINATION.

(A)  IN GENERAL.

SUBJECT TO THIS SECTION, IF AN APPLICANT FAILS AN
EXAMINATION GIVEN UNDER THIS SUBTITLE, THE APPLICANT MAY RETAKE
THE EXAMINATION.

(B)  PROCEDURE ON 1ST OR 2ND FAILURE.

EXCEPT AS PROVIDED IN SUBSECTION (C) OF THIS SECTION, AN
APPLICANT FOR REEXAMINATION SHALL:

(1)  SUBMIT TO THE BOARD A REQUEST FOR REEXAMINATION
ON THE FORM THAT THE BOARD PROVIDES; AND

(2)  PAY TO THE BOARD THE REEXAMINATION FEE SET BY THE
BOARD TO REFLECT THE COST OF REEXAMINATION.

(C)  PROCEDURE ON 3RD FAILURE.

AN APPLICANT WHO FAILS 2 REEXAMINATIONS GIVEN UNDER THIS
SECTION MAY TAKE THE EXAMINATION AGAIN ONLY ON A NEW APPLICATION
FOR A LICENSE THAT IS SUBMITTED TO THE BOARD AT LEAST 2 YEARS
AFTER THE APPLICANT LAST FAILED A REEXAMINATION.

(D)  FEE NOT REFUNDABLE.

A REEXAMINATION FEE PAID TO THE BOARD UNDER SUBSECTION
(B)(2) OF THIS SECTION IS NOT REFUNDABLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 75 1/2, §
14(d)(1) and (e).

In subsection (c) of this section, the phrase "after
the applicant last failed a reexamination" is added to
clarify the 2-year period.
