purpose of

clarifying circumstances for refund of filing fees.

By amending the following sections of the Montgomery County
Zoning Ordinance, Chapter 59 of the Montgomery County Code:

Section 59-H-2.33 "Refund of Filing Fees"

AN AMENDMENT to the Montgomery County Zoning Ordinance for the
purpose of

Clarifying That Land or. Rights of way Within the
Jurisdiction of or Owned or Controlled By the State of
Maryland, Montgomery County or Other Political
Subdivision or Government Entity or Agency, or the
Washington Metropolitan Area Transit Authority
("WMATA"), May Be Included in Applications for
Approval of Development Plans, Project Plans for
Optional Method of Development and Site Plans,
Provided That the Application Includes an Agency
Agreement or Other Written Authority from the
Applicable Government Entity, Agency or WMATA
Authorizing the Applicant to Include Said Public Land
or Rights of way Within the Application.

By amending the following sections of the Montgomery County
Zoning Ordinance, Chapter 59 of the Montgomery County Code:

Section 59-D-3.21 "Contents of Site Plan"
