Providing reference in the language of the Subdivision

Ordinance that the Planning Board, in acting on a

subdivision plan, shall consider any recommendations
provided by the area master plan.

Requiring that a preliminary plan of subdivision must
be in substantial conformance with a master plan
except under certain circumstances.

By amending the following sections of the Montgomery County
Subdivision Regulations, Chapter 50 of the Montgomery County
Code:

Article III                              "Subdivision Regulations Generally"

Section 50-29                          "Lot Design"

Section 50-30                          "Public Sites and Adequate

Open Spaces"

Section 50-35                          "Preliminary Subdivision Plans--

Approval Procedure"

Effective Date July 25, 1988

Subdivision Regulations Amendment No. 88-2

AN AMENDMENT to the Montgomery County Subdivision Regulations for
the purpose of

Clarifying That Land or Rights of way Within the
Jurisdiction of, or Owned or Controlled by the State
of Maryland, Montgomery County or Other Political
Subdivision or Government Entity or Agency, or the
Washington Metropolitan Area Transit Authority
("WMATA"), May Be Included in Applications for
Approval of Preliminary Subdivision Plans, Provided
that the Application Includes an Agency Agreement or
Other Written Authority from the Applicable Government
Entity, Agency, or WMATA Authorizing the Applicant to
Include Said Public Land or Rights of way Within the
Application.

By amending the following sections of the Montgomery County
Subdivision Regulations, Chapter 50 of the Montgomery County
Code:
