Ch. 3

LAWS OF MARYLAND

SUBJECT TO THE RULES ADOPTED BY THE COURT OF APPEALS, THE
BOARD PERIODICALLY SHALL GIVE EXAMINATIONS TO APPLICANTS AT THE
TIMES AND PLACES THAT THE BOARD DETERMINES.

(C)  NOTICE OF EXAMINATION.

THE BOARD SHALL GIVE EACH APPLICANT NOTICE OF THE TIME AND
PLACE OF EXAMINATION.

(D)  SUBJECTS AND METHOD OF EXAMINATION.

SUBJECT TO THE RULES ADOPTED BY THE COURT OF APPEALS, THE
BOARD SHALL DETERMINE THE SUBJECTS, SCOPE, AND FORM OF AND THE
PASSING SCORE FOR EXAMINATIONS.

(E)  EXAMINATION RESULTS.

THE BOARD SHALL REPORT TO THE COURT OF APPEALS:

(1)  THE RESULTS OF EACH EXAMINATION THAT THE BOARD
GIVES; AND

(2)  RECOMMENDATIONS ABOUT THE CHARACTER AND
REPUTATION OF EACH APPLICANT WHO PASSES THE EXAMINATION.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from the
first clause of former Art. 10, § 5.

Subsection (b) of this section is standard language
added to state expressly that which only was implied
in the former law -- i.e., subject to the rules of the
Court of Appeals, the Board determines the times and
places of examinations.

Subsection (c) of this section is standard language
added to conform to the practice of the Board. It
provides an element of fundamental fairness by
requiring the Board to give qualified applicants
notice before the administration of examinations.

Subsection (d) of this section is standard language
substituted for the second sentence of former Art. 10,
§ 3(b), which required examinations "touching ... [the
applicant's] qualifications for admission to the bar".
The substituted language clarifies that, subject to
the rules of the Court of Appeals, the Board
determines the content and scoring of the required
examinations.

Subsection (e) of this section is new language derived
without substantive change from the first sentence of
former Art. 10, § 3(c).
