SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 78B - Racing Commission

1.

(A) There [shall be] IS a Maryland Racing Commission [,
which shall be part of] WITHIN the Department of Licensing and
Regulation[, and the same is hereby created and established,
which said].

(B)  THE Maryland Racing Commission shall [be vested with
and possessed of] HAVE the powers and duties in this article
specified and also the powers necessary or proper to enable it to
carry out fully and effectually all the purposes of this article.

(C) The (1) NOTWITHSTANDING EXCEPT AS PROVIDED IN PARAGRAPH
(2) OF THIS SECTION SUBSECTION, THE jurisdiction, supervision,
powers and duties of the Maryland Racing Commission [herein
created and established] shall extend [under this article] to any
and all person or persons, associations or corporations [which
shall hereafter hold or conduct] THAT HOLDS OR CONDUCTS any
meeting within the State of Maryland [whereat] WHERE:

(1) [horse] HORSE racing shall be permitted
[for any stake, purse or reward.]; AND

(2) PARIMUTUAL WAGERING IS CONDUCTED.

(2) PARAGRAPH (1) OF THIS SECTION SUBSECTION MAY NOT
BE CONSTRUED TO APPLY TO THE FOLLOWING RACES UNLESS PARIMUTUEL
BETTING IS CONDUCTED:

(I)  THE MARYLAND HUNT CUP;

(II)  THE GRAND NATIONAL;

(III)  RACES HELD AT THE CAPE PINE FARM IN
CHURCH HILL, QUEEN ANNE'S COUNTY;

(IV)  THE POTOMAC TRIALS;

(V)  THE MARLBORO TRIALS; AND

(VI)  THE ELKRIDGE-HARFORD POINT TO POINT; AND
(VII) ANY OTHER STEEPLECHASE OR HUNT-TYPE RACES.

(D) The exercise or performance of all powers, authority,
duties and functions vested in the Commission by the provisions
of this article shall be subject to the power and authority of
