the Secretary of Licensing and Regulation as set forth in Article
41 of this Code, or elsewhere in the laws of this State.
(a) Any person or persons, association or corporation,
desiring to conduct racing AND PARIMUTUAL BETTING within the
State of Maryland during any calendar year, shall apply to the
Maryland Racing Commission for a license so to do. Such
application shall be filed with the executive director of the
Commission on or before a day to be fixed by the Commission.
Such application shall specify the days on which such racing is
desired to be conducted or held, and such application shall be in
such form and supply such data and information as the said
Maryland Racing Commission shall prescribe.
(iv) A person who has never been convicted of
any crime involving moral turpitude.
(3) The Governor shall designate 1 member of the
Commission to serve as chairman of the Commission for a [2-year]
1-YEAR term. [The chairman is eligible for reappointment as
Chairman] THE CHAIRMANSHIP SHALL ROTATE EVERY 2 YEARS THE
CHAIRMAN MAY SERVE NO MORE THAN 2 CONSECUTIVE TERMS.-------- ---
(b) No person shall be eligible for appointment or shall
hold the office of commissioner or be appointed by the
Commission, or hold any office or position under the Commission,

(a) (1) The Maryland Racing Commission shall consist of [7]
9 members, each of whom shall be appointed by the Governor, with
the advice and consent of the Senate of Maryland. Not more than
[5] 6 commissioners may be of the same political party. At the
time of appointment and qualification, at least [2] 3
commissioners shall be knowledgeable or experienced in some
aspect of thoroughbred racing, and at least [2] 3 other
commissioners shall be knowledgeable or experienced in some
aspect of harness racing.
(2) Each commissioner, at the time of appointment and
qualification to the Commission, shall be:
(i) A resident of the State of Maryland who
shall have resided in the State for at least five years next
preceding appointment and qualification;
(ii) A qualified voter in the State of
Maryland;
(iii) Not less than twenty-five years of age;
