SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

19.

(a) A Class B beer, wine and liquor license shall be issued
by the clerk of the circuit court of the county in which the
place of business is located, and the license authorizes its
holder to keep for sale and sell all alcoholic beverages at
retail at any hotel or restaurant at the place described, for
consumption on the premises or elsewhere, or as provided in the
following subsections. The annual fee for this license is $750,
except as provided, and is payable to the clerk, before any
license is issued, for distribution as provided in this article.

[(p) In Kent County, the annual fee for this license is
$2,000.]

(P) (1) THE KENT COUNTY BOARD OF LICENSE COMMISSIONERS MAY
ISSUE A CLASS B BEER, WINE AND LIQUOR LICENSE FOR USE IN A
RESTAURANT.

(2)  TO QUALIFY FOR LICENSURE UNDER THIS SUBSECTION,
THE RESTAURANT SHALL:

(I)  BE FULLY EQUIPPED WITH A PROPER AND
ADEQUATE DINING ROOM;

(II)  HAVE SUFFICIENT FACILITIES FOR PREPARING
AND SERVING MEALS TO THE PUBLIC; AND

(III)  BE APPROVED BY THE BOARD OF LICENSE
COMMISSIONERS.

(3)  WHEN OPERATING UNDER THIS LICENSE, A HOLDER'S
AVERAGE DAILY RECEIPTS FROM THE SALE OF FOOD SHALL COMPRISE AT
LEAST 60 PERCENT OF THE AVERAGE DAILY RECEIPTS OF THE BUSINESS.
