REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
278(g).

In item (2) of this section, the former word
"affirmations" is deleted as unnecessary in light of
the word "oaths". See Art. 1, § 9 of the Code.

9-206. MISCELLANEOUS POWERS AND DUTIES.

(A)  POWERS.

IN ADDITION TO ANY POWERS SET FORTH ELSEWHERE, THE BOARD MAY
ADOPT:

(1)  ANY REGULATION TO CARRY OUT THIS TITLE; AND

(2)  A SEAL.

(B)  DUTY.

IN ADDITION TO ANY DUTIES SET FORTH ELSEWHERE, THE BOARD
SHALL KEEP A RECORD OF ITS PROCEEDINGS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
278(e), (f), and, as it related to regulations, (c).

The introductory phrases of subsections (a) and (b) of
this section, "[i]n addition to any [powers and
duties] set forth elsewhere", are added to clarify
that the enumerated powers and duties are not
exhaustive. Accordingly, former Art. 56, § 278(a),
which stated "[t]he Board shall have the powers and
duties listed in this section", is deleted as
misleading surplusage.

In subsection (a)(1) of this section, the former words
"as it deems necessary" are deleted as unnecessary in
light of the word "may". In any event, the Secretary
has supervisory responsibility over rulemaking. See
Art. 41, §§ 1-202 and 8-104(b) of the Code.

In subsection (a)(2) of this section, the former
reference to using the seal "in transacting its
official business" is deleted as surplusage.

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, that
most of the titles of this article include a provision
that indicates that the licensing boards exercise
