(C) STAFF.

THE BOARD MAY EMPLOY A STAFF IN ACCORDANCE WITH THE STATE
BUDGET.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
277(b) and the second clause of (c) and § 278(b).

In subsection (a) of this section, the phrase "at the
times and places that the Board determines" is
standard language added for clarity.

In subsection (b)(2) of this section, the former
reference to expenses "incurred in carrying out their
duties" is deleted as unnecessary in light of the
reference to the Standard State Travel Regulations.
See COMAR 23.02.01.01 through 12.

The second sentence of former Art. 56, § 278(d), which
enabled the Board to hold "such other meetings and
hearings as required", is deleted as unnecessary in
light of the phrase "at least" in subsection (a) of
this section.

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, the
lack of an express provision establishing the number
of members who constitute a quorum. In the absence of
an express provision, case law indicates that a
majority of the members is a quorum. See Gemeny v.
Prince George's County, 264 Md. 85, 285 A.2d 602
(1972); Zeiler v. Central Ry., 84 Md. 304, 35 A. 932
(1896); and Heiskell v. Mayor of Baltimore, 65 Md.
125, 4 A. 116 (1886).

9-205. ENFORCEMENT POWERS.

TO ENFORCE THIS TITLE, THE BOARD MAY:

(1)  CONDUCT INVESTIGATIONS AND HOLD HEARINGS ON ANY
MATTER COVERED BY THIS TITLE, AT ANY TIME AND PLACE IN THE STATE;

(2)  ADMINISTER OATHS;

(3)  EXAMINE WITNESSES; AND

(4)  RECEIVE EVIDENCE.
