WILLIAM DONALD SCHAEFER, Governor Ch. 700

1. THERE IS CENSUS DATA OR OTHER
INFORMATION THAT DEMONSTRATES A NEED FOR THE PROGRAM WITHIN THE

REGION SERVED BY THE LOCAL GOVERNMENT OR NONPROFIT ORGANIZATION;

AND ------------------------------

2. AN APPLICANT TO THE PROGRAM CAN
BENEFIT BY RECEIVING TECHNICAL ASSISTANCE FROM A NONPROFIT
ORGANIZATION OR LOCAL GOVERNMENT.

(II) THE TOTAL AMOUNT OF TECHNICAL ASSISTANCE
GRANTS MAY NOT EXCEED 10 PERCENT OF THE BUDGETED PROGRAM FUNDS
DURING ANY FISCAL YEAR.

(III) THE DEMONSTRATION PROJECT SHALL TERMINATE
ON JUNE 30, 1991.

(IV) THE DEPARTMENT SHALL REPORT TO THE GENERAL
ASSEMBLY, IN ACCORDANCE WITH § 2-1312 OF THE STATE GOVERNMENT
ARTICLE, ON OR BEFORE NOVEMBER 30, 1989, ON ITS PLANS TO PROVIDE
TECHNICAL ASSISTANCE GRANTS OR OTHER OPERATING SUPPORT TO
NONPROF1T ORGANIZATIONS THAT FACILITATE THE USE OF THE
DEPARTMENT'S PROGRAM BY RESIDENTS OF LOCAL JURISDICTIONS.

(c) (1) To qualify for an indoor plumbing loan, an owner of
a building:

(i) Must reside in the building and be a family
of limited income, or must rent at least two-thirds of the
dwelling units in the building to families of limited income;

(ii) Must own a building that is:

1.  Structurally sound; and

2.  In need of indoor plumbing pipes,
equipment, wells, septic tanks or other on-site sewerage system,
or connection to community water and sewerage systems, and have
no or incomplete indoor plumbing or an existing failing septic
system; and

(iii) Must submit to the Department a proposal
for installation of the necessary facilities to provide adequate
and functional indoor plumbing for water and sewage disposal
systems, including any septic system, wells, or connection to
existing community sewer and water systems which complies with
the Department of the Environment requirements and any and all
other governmental entities having jurisdiction over such
systems.

(2) If a building is not structurally sound, to
qualify for an indoor plumbing loan, the owner of the building,
in addition to the requirements of paragraph (1) of this
