WILLIAM DONALD SCHAEFER, Governor

Ch. 3

Subsection (b)(1) of this section is new language
added to provide expressly that the application form
for a beauty salon permit must provide space where an
applicant may indicate that the application is being
made for an owner-manager permit or for a limited
practice beauty salon. This addition is implied from
the references to the existence of an owner-manager
permit or a permit for a limited practice beauty salon
and the resulting need of the Board to know what type
of beauty salon permit is to be issued. This addition
also conforms to the practice of the Board.

In subsection (b)(2) of this section, the word
"senior", which formerly modified the word "manager",
is deleted since the Board issues only 1 type of
manager license.

The fourth sentence of former Art. 56, § 480(c), which
made the fee for an owner-manager certificate the same
as the fee for an owner certificate, is deleted as
encompassed in the fee requirement for a beauty salon
permit.

Defined terms: "Beauty salon" § 5-101

"Beauty salon permit" § 5-101 "Board" § 5-101

"Person" § 1-101

5-505. ISSUANCE OF BEAUTY SALON PERMIT.

(A)  IN GENERAL.

THE BOARD SHALL ISSUE A BEAUTY SALON PERMIT TO EACH
APPLICANT WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE.

(B)  LIMITED PRACTICE BEAUTY SALON PERMIT.

A BEAUTY SALON PERMIT FOR THE LIMITED PRACTICE OF
COSMETOLOGY SHALL SPECIFY THE LIMITED COSMETOLOGY SERVICES FOR
WHICH THE PERMIT IS ISSUED.

(C)  CONTENTS.

THE BOARD SHALL SEAL EACH BEAUTY SALON PERMIT THAT THE BOARD
ISSUES WITH ITS OFFICIAL SEAL.

REVISOR'S NOTE: Subsection (a) of this section is standard
language added to state expressly that which only was
implied in the former law -- i.e., the Board must
issue a permit to a qualified applicant.

Subsection (b) of this section is new language added
for clarity. This addition is based on the references
to limited practice beauty salons.
