Ch. 3

Subsection (d) of this section is new language added
to state expressly that, if the Board chooses to
inspect a beauty salon, it must pass the inspection.

Subsection (e) of this section is new language added
to make express reference to any other requirements
the Board may set under § 5-205 of this title.

5-503. SUPERVISION BY MANAGER.

(A)  REQUIRED.

EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, WHENEVER A
BEAUTY SALON IS IN OPERATION, IT SHALL BE UNDER THE DIRECT
SUPERVISION OF AN INDIVIDUAL WHO IS LICENSED TO MANAGE A BEAUTY
SALON.

(B)  CHANGE IN MANAGERS.

A BEAUTY SALON PERMIT HOLDER PROMPTLY SHALL SUBMIT TO THE
BOARD WRITTEN NOTICE OF EACH CHANGE OF MANAGERS OF THE BEAUTY
SALON.

(C)  LIMITED PRACTICE BEAUTY SALONS.

A LIMITED PRACTICE BEAUTY SALON AUTHORIZED UNDER § 5-501(B)
OF THIS SUBTITLE:

(1)  IS NOT REQUIRED TO BE OPERATED UNDER THE DIRECT
SUPERVISION OF A LICENSED MANAGER; BUT

(2)  SHALL BE OPERATED IN ACCORDANCE WITH THE
REGULATIONS THAT THE BOARD ADOPTS TO GOVERN THE DIRECT
SUPERVISION OF THE OPERATION OF LIMITED PRACTICE BEAUTY SALONS.

REVISOR'S NOTE: Subsections (a), (b), and (c)(1) of this
section are new language derived without substantive
change from former Art. 56, § 479(f), the fifth
sentence of § 480(c), and the second sentence of §
482(c).

Subsection (c)(2) of this section is new language
added to state expressly that which only was implied
by the third sentence of former Art. 56, § 482(c),
which required the Board to adopt regulations about
supervision, and former Art. 56, § 498(a), which
allowed disciplinary action against a person who
violates any regulation of the Board. See §§ 5-205
and 5-523(1) of this title.
