CHAPTER 265

(House Bill 1108)

AN ACT concerning

Charles County - Transfer of Alcoholic Beverages Licenses

FOR the purpose of requiring the Charles County Board of License
Commissioners to investigate whether a transferee of an
alcoholic beverages license has a police record; preserving
the confidentiality of this information; and requiring the
Board to consider the existing need for any proposed
location transfer of an alcoholic beverages license.

BY repealing and reenacting, with amendments,

Article 2B - Alcoholic Beverages

Section 74(c)

Annotated Code of Maryland

(1987 Replacement Volume and 1988 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

74.

(c) (1) In Charles County the fee for assignment and/or
transfer of a license shall be $200.

(2)  (I) IF AN ALCOHOLIC BEVERAGES LICENSE IS TO BE
TRANSFERRED TO A DIFFERENT HOLDER, THE CHARLES COUNTY BOARD OF
LICENSE COMMISSIONERS SHALL INVESTIGATE WHETHER THE TRANSFEREE
HAS A POLICE RECORD OF CRIMINAL CONVICTIONS.

(II) THE BOARD SHALL ADOPT REGULATIONS FOR
PRESERVING THE CONFIDENTIALITY OF THE POLICE RECORDS SECURED
UNDER THIS SUBSECTION.

(3)   IF AN ALCOHOLIC BEVERAGES LICENSE IS TO BE
TRANSFERRED TO A DIFFERENT LOCATION, THE CHARLES COUNTY BOARD OF
LICENSE COMMISSIONERS SHALL CONSIDER THE EXISTING NEED FOR THAT
CLASS OF LICENSE AT THE PROPOSED NEW LOCATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.
