CHAPTER 264

(House Bill 1107)

AN ACT concerning

Charles County - Alcoholic Beverages - "Go Cup"

FOR the purpose of prohibiting retail alcoholic beverages
licensees in Charles County from selling or giving a person
a "go cup" for off-premises use for consuming alcoholic
beverages; and making the provisions of this Act severable.

BY adding to

Article 2B - Alcoholic Beverages

Section 122A

Annotated Code of Maryland

(1987 Replacement Volume and 1988 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

122A.

IN CHARLES COUNTY, A RETAIL ALCOHOLIC BEVERAGES LICENSEE MAY
NOT SELL OR GIVE ANY PERSON OR OTHERWISE PROVIDE ANY PERSON WITH
A CUP COMMONLY KNOWN AS A "GO CUP" FOR OFF-PREMISES USE FOR
CONSUMING ALCOHOLIC BEVERAGES.

SECTION 2. AND BE IT FURTHER ENACTED, That if any provision
of this Act or the application thereof to any person or
circumstance is held invalid for any reason in a court of
competent jurisdiction, the invalidity does not affect other
provisions or any other application of this Act which can be
given effect without the invalid provision or application, and
for this purpose the provisions of this Act are declared
severable.

SECTION 3. 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1989.
