In subsections (b)(3), (c)(3), and (d)(3) of this
section, the phrase "by regulation" is added for
clarity. As to the rulemaking authority of the Board,
see § 5-205 of this title.

In subsections (b)(4), (c)(4), and (d)(4) of this
section, the references to licensure to provide
esthetic, manicuring, or wig styling services are
substituted for the former reference to being licensed
as a cosmetician, which was misleading. In practice,
courses in a limited practice of cosmetology are
taught by individuals licensed to provide the category
of service to be taught.

5-309. SAME -- LICENSE TO MANAGE.

(A)  IN GENERAL.

TO QUALIFY FOR A LICENSE TO MANAGE A BEAUTY SALON, AN
APPLICANT SHALL BE AN INDIVIDUAL WHO MEETS THE REQUIREMENTS OF
THIS SECTION.

(B)  AGE.

AN APPLICANT SHALL BE AT LEAST 18 YEARS OLD.

(C)  EXPERIENCE.

AN APPLICANT SHALL:

(1)  BE A LICENSED COSMETOLOGIST; AND

(2)  HAVE AT LEAST 2 YEARS OF EXPERIENCE AS A LICENSED
COSMETOLOGIST.

(D)  EXAMINATION.

AN APPLICANT SHALL PASS AN EXAMINATION GIVEN BY THE BOARD
UNDER THIS SUBTITLE.

REVISOR'S NOTE: Subsection (a) of this section is new
language added to introduce the basic requirements for
an applicant for a license.

Subsections (b) and (c) of this section are new
language derived without substantive change from the
first sentence of former Art. 56, § 482(c).
