Ch. 3

LAWS OF MARYLAND

Subsection (d) of this section is new language derived
without substantive change from former Art. 56, § 481,
as it related to passing an examination to manage a
beauty shop, and rephrased in standard language used
throughout this article.

In subsection (a) of this section, the former
reference to "senior manager" is omitted since there
is only 1 category of licenses to manage a beauty
salon.

Subsection (c)(1) of this section is revised to state
affirmatively that an individual may apply for a
managers license only if the individual is a licensed
cosmetologist. This revision avoids the ambiguity in
the first sentence of former Art. 56, § 482(c), which
seemed to impose the requirements now revised in
subsections (b) and (c)(2) of this section only on
licensed cosmetologists, while imposing no
requirements on other applicants. In practice, no
other applicants may apply.

In subsection (c)(2) of this section, the phrase "at
least" is added to clarify that the number is a
minimum number.

Defined terms: "Beauty salon" § 5-101
"Board" § 5-101 "License" § 5-101
"Licensed cosmetologist" § 5-101

5-310. APPLICATIONS FOR LICENSES.

AN APPLICANT FOR A LICENSE:

(1)  SHALL SUBMIT TO THE BOARD AN APPLICATION ON THE
FORM THAT THE BOARD PROVIDES; AND

(2)  EXCEPT AS PROVIDED IN § 5-312 OF THIS SUBTITLE,
SHALL PAY TO THE BOARD AN APPLICATION FEE OF:

(I)  $5 FOR A LICENSE TO PRACTICE COSMETOLOGY;
OR

(II)  $10 FOR ANY OTHER LICENSE.

(B)  DEMONSTRATING SERVICES.

IN ADDITION TO THE OTHER REQUIREMENTS OF THIS SECTION, AN
APPLICANT FOR A LICENSE TO PROVIDE DEMONSTRATING SERVICES SHALL
