"PROVIDE DEMONSTRATING SERVICES" MEANS TO DEMONSTRATE TO AN
INDIVIDUAL, FOR COMPENSATION, ANY BEAUTY PREPARATION OR BEAUTY
EQUIPMENT.
REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Art. 56, §
479(h).
The term "provide demonstrating services" is
substituted, as the defined term, for the former word
"demonstrator", to standardize use of defined terms
throughout this title. Thus, the substituted language
states the definition in the infinitive form to allow
minor verb variations of the defined term without
taking these variations out of the scope of the
definition.
The former limitations "upon a patron" and "in a
beauty shop" are deleted as incorrect in light of §
5-607 of this title, which allows services in places
other than beauty salons and implicitly allows service
to individuals other than beauty salon patrons in some
instances. See the revisor's note to § 5-607 of this
title.
The former phrases "whether paid by a regular employer
or not" and "for profit" are deleted as unnecessary
since the phrase "for compensation" is broad enough to
encompass payment from any source.
(M) PROVIDE ESTHETIC SERVICES.
"PROVIDE ESTHETIC SERVICES" MEANS TO PROVIDE TO AN
INDIVIDUAL, FOR COMPENSATION, THE SERVICE OF:
(1) CLEANSING, EXERCISING, MASSAGING, STIMULATING, OR
PERFORMING ANY OTHER SIMILAR PROCEDURE ON THE ARMS, FACE, HANDS,
OR SCALP BY ELECTRICAL, MECHANICAL, OR ANY OTHER MEANS;
(2) APPLYING TO THE FACE AN ANTISEPTIC, CREAM,
LOTION, TONIC, OR COSMETIC PREPARATION; OR
(3) REMOVING SUPERFLUOUS HAIR BY THE USE OF A
DEPILATORY, TWEEZERS, OR WAX.
