Ch. 96                                           LAWS OF MARYLAND

ENFORCEMENT DUTIES AND POWERS OF THE DIVISION OF CONSUMER
PROTECTION OF THE OFFICE OF THE ATTORNEY GENERAL, AS DESCRIBED IN
TITLE 13 OF THE COMMERCIAL LAW ARTICLE.

9-111.

(A)  A PERSON MAY NOT KNOWINGLY MAKE OR CAUSE ANY FALSE
STATEMENT OR REPORT TO BE MADE IN ANY DOCUMENT REQUIRED TO BE
FURNISHED TO THE SECRETARY, THE DEPARTMENT, OR ANY OTHER PERSON
OR ENTITY IN CONNECTION WITH THIS TITLE.

(B)  A PERSON MAY NOT KNOWINGLY MAKE OR CAUSE ANY FALSE
STATEMENT OR REPORT TO BE MADE FOR THE PURPOSE OF INFLUENCING THE
ACTION OF THE DEPARTMENT IN CONNECTION WITH THIS TITLE.

(C)  ANY PERSON WHO VIOLATES ANY PROVISION OF THIS TITLE IS:

(1) SUBJECT TO CIVIL LIABILITY AND TO A FINE CIVIL
MONETARY PENALTY NOT EXCEEDING $500,000; AND

(2) IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS
SUBJECT TO A FINE NOT EXCEEDING $500,000 OR IMPRISONMENT NOT
EXCEEDING 5 YEARS OR BOTH $1,000,000.

9-112.

BY REGULATION, THE SECRETARY SHALL ESTABLISH STANDARDS AND
REQUIREMENTS TO EFFECTUATE THE PURPOSES OF THIS ACT.

9-113.

THIS TITLE DOES NOT REDUCE ANY OBLIGATIONS OR RIGHTS OF A
TENANT, LOCAL GOVERNMENT, OR AN OWNER UNDER THE PROVISIONS OF
TITLE 11 OF THE REAL PROPERTY ARTICLE.

9-114.

THIS TITLE MAY BE CITED AS THE "ASSISTED HOUSING
PRESERVATION ACT".

SECTION 2. AND BE IT FURTHER ENACTED, That if any provision
of this Act or the application thereof to any person or
circumstance is held invalid for any reason in a court of
competent jurisdiction, the invalidity does not affect other
provisions or any other application of this Act which can be
given effect without the invalid provision or application, and
for this purpose the provisions of this Act are declared
severable.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
be construed only prospectively and may not be applied or
