A. For the purposes of this Article [VI] IX, the term
"financial assistance" means loans, grants or loan
guarantees, and the term "recipient" means any
organization which is the ultimate recipient or intended
beneficiary of a loan, grant or a loan guaranteed by the
State.
B. A State agency may not approve State financial
assistance to any recipient which is engaged in
discriminatory practices. Each State agency shall
monitor its financial assistance programs to assure that
recipients do not engage in discriminatory practices in
violation of this Executive Order.
C. On or before the date of any delivery of financial
assistance, an authorized officer of each recipient
shall certify that discrimination is prohibited by the
recipient.
D. The organizational documents of the recipient shall
contain, within 90 days of any delivery of financial
assistance, a non-discrimination clause, or in the
alternative, the documents evidencing the State's
financial assistance shall contain a covenant by the
recipient not to discriminate. Failure to change the
organizational documents, if necessary, within 90 days
of any delivery of financial assistance, obligates the
recipient to repay the award, along with interest, at a
rate to be determined by the approving agency.
E. Recipients of State financial assistance shall submit to
the approving agency, at its request, information
relating to the recipient's operations, with regard to
political or religious opinion or affiliation, marital
status, physical or mental handicap, race, color, creed,
sex, age, or national origin. Such information shall be
furnished on a form to be prescribed by the agency.
Article [VII] X - Other Government Bodies
All political subdivisions and other instrumentalities of
government are requested to cooperate in this endeavor to
the end that any and all discrimination within the State is
eliminated.
Article XI - Publication of Code of Fair Practices
Copies of the Code shall be distributed to all State
officials and employees and copies shall be posted in
conspicuous locations in all State facilities.
