Ch. 648

LAWS OF MARYLAND

(D) INVESTIGATION OF QUALIFICATIONS.

THE STATE BOARD MAY INVESTIGATE THE QUALIFICATIONS OF EACH
APPLICANT TO DETERMINE WHETHER THE APPLICANT MEETS THE
REQUIREMENTS OF THIS SECTION.

COMMITTEE COMMENT: Subsections (a), (b)(l)(i) and (2), (c),
and (d) are new language derived from former Art. 56,
§ 534(b), the fourth sentence of (c), and the second
sentence of (d) and the second clause of § 530.

Subsection (b)(1)(ii) is new language added to
accommodate the interpretation of the State Board that
an applicant may apply experience gained under the
supervision and direction of a master electrician
employed by a governmental unit. This interpretation
will allow the State Board to credit an applicant with
7 years of experience, as opposed to 3 years as
required under the former law.

In subsection (a) of this section, the defined term
"State license" is substituted for the former
reference to "a license to engage in the business on a
statewide basis", for clarity.

In subsection (b)(1) of this section, the defined term
"provid{ing} electrical services" is substituted for
the former references to "electrical construction,
maintenance, installation, and repair", for clarity
and brevity.

Also in subsection (b)(1) of this section, the phrase
"preceding the date of the application", which
formerly modified the word "years", is deleted as
surplusage.

In subsection (d) of this section, the power to
"determine whether the applicant meets the
requirements of this section" is substituted for the
former phrase "including the education and experience
required by subsection (b) of this section", for
clarity.

Also in subsection (d) of this section, the former
requirement for receipt of the application and fee
before investigation is deleted as surplusage.

As to the form of the examination, see § 2-306(e) of
this subtitle.

Defined terms: "Master electrician" § 2-101

"Provide electrical services" § 2-101

"State Board" § 2-101 "State license" § 2-101
