WILLIAM DONALD SCHAEFER, Governor Ch. 648

2-305. APPLICATIONS FOR STATE LICENSES.

AT LEAST 45 DAYS BEFORE THE EXAMINATION DATE, AN APPLICANT
FOR A STATE LICENSE SHALL:

(1)  SUBMIT AN APPLICATION TO THE STATE BOARD ON THE
FORM THAT THE STATE BOARD PROVIDES; AND

(2)  PAY TO THE STATE BOARD AN APPLICATION FEE OF $35.

COMMITTEE COMMENT: This section is new language derived
from former Art. 56, § 536(d) and the second sentence
of § 534(c) and the first sentence of (d).

The introductory language of this section is revised
to apply to the payment of the fee, as well as
submission of the application. Accordingly, in item
(2) of this section, the term "application fee" is
substituted for the former term "{e}xamination fee"
because the fee is paid, in fact, on application for a
license for both the application and examination
process.

In light of this substitution, the fourth sentence of
former Art. 56, § 534(d), which made the examination
fee nonrefundable, is deleted as unnecessary.

The second clause of former Art. 56, § 534(a), which
required the State Board to provide forms, is deleted
as unnecessary in light of item (1) of this section.

Defined terms: "State Board" § 2-101
"State license" § 2-101

2-306. EXAMINATIONS.

(A)  RIGHT TO EXAMINATION.

AN APPLICANT WHO OTHERWISE QUALIFIES FOR A STATE LICENSE IS
ENTITLED TO BE EXAMINED AS PROVIDED IN THIS SECTION.

(B)  TIME AND PLACE OF EXAMINATION.

THE STATE BOARD SHALL GIVE EXAMINATIONS TO APPLICANTS AT
LEAST TWICE A YEAR, AT THE DATES, TIMES, AND PLACES THAT THE
STATE BOARD DETERMINES.

(C)  NOTICE OF EXAMINATION.
