LAWS OF MARYLAND

ON PAYMENT OF THE APPROPRIATE LICENSE FEE AND, IF
APPLICABLE, RECEIPT OF THE PROOF OF THE INSURANCE REQUIRED UNDER
§ 3-501 OF THIS TITLE, THE BOARD SHALL ISSUE A LICENSE TO EACH
APPLICANT WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE.

COMMITTEE COMMENT: Subsection (a)(1) of this section is new
language added to state expressly that the Board is
required to give notice to qualified applicants. This
addition conforms to the current practice of the
Board.

Subsection (a)(2)(i) of this section and the
reference, in subsection (b) of this section, to
"receipt of the proof of the insurance required under
§ 3-501 of this title" are new language added to
conform to the insurance requirements of former Art.
56, § 462C — now § 3-501 of this title.

Subsection (a)(2)(ii) of this section is new language
derived from the first clause of the first sentence of
former Art. 56, § 450 and the first clause of the
first sentence of § 453(b) and rephrased as part of
the notice requirement.

Subsection (b) of this section is new language
substituted for the first clause of the sixteenth
sentence of former Art. 56, § 449(a), which provided
that "they or any 5 of them, shall grant" a master
plumber license to a qualified applicant and register
the applicant in their books and was unnecessary and
possibly misleading. While members of the Board may
participate in determining whether an applicant meets
the requirements for the issuance of a license under
this subtitle, the Board does not have the discretion,
by a vote, to deny a license to a qualified applicant,
for any license.

In subsection (a)(2)(ii)l. of this section, the
references to a "master plumber license" or "limited
master plumber license" are substituted for the former
references to a "certificate" of competency, to
conform to the terminology used throughout this title.
Similarly, in subsection (a)(2)(ii)2. of this section,
the references to a "journey plumber license" or
"limited journey plumber license" are substituted for
the former reference to a "first certificate to a
journeyman plumber". See the General Committee
Comment to this title.
