Subsection (b) of this section is new language derived
from the second clause of the second sentence of
former Art. 56, § 444(a).

Subsection (c) of this section is new language added
to allow the Board to enter into an agreement with a
county for enforcement of the applicable plumbing
code.

Subsection (b) of this section is revised to require a
specific determination by the Board to ensure that a
plumbing code is enforced in each county.

The Committee was apprised of the problem that the
Board does not have the resources to enforce the State
Plumbing Code in a county that does not enact or
enforce a local plumbing code. Nonetheless, the
Committee believes that a code should be in force in
each county and that the provision of money and other
resources to carry out enforcement should be addressed
separately.

3-207. MISCELLANEOUS POWERS AND DUTIES.

(A)  POWERS OF BOARD.

IN ADDITION TO THE POWERS SET FORTH ELSEWHERE IN THIS TITLE,
THE BOARD MAY ADOPT REGULATIONS TO CARRY OUT THE PROVISIONS OF
THIS TITLE.

(B)  DUTIES OF BOARD.

IN ADDITION TO THE DUTIES SET FORTH ELSEWHERE IN THIS TITLE,
THE BOARD SHALL ENFORCE THE PROVISIONS OF THIS TITLE.

COMMITTEE COMMENT: This section is new language derived
from the seventh clause of the third sentence of
former Art. 56, § 449(a) and the first clause of the
first sentence of § 453(a).
