ENFORCEMENT OF PLUMBING CODES.
(A) REQUIRED; LOCAL CODES ALLOWED.
A COUNTY SHALL:
(1) ENFORCE THE STATE PLUMBING CODE; OR
(2) ADOPT AND ENFORCE A LOCAL PLUMBING CODE THAT
MEETS OR EXCEEDS THE MINIMUM STANDARDS OF THE STATE PLUMBING CODE
FOR THE PROPER DESIGN, ACCEPTABLE INSTALLATION, AND ADEQUATE
MAINTENANCE OF PLUMBING SYSTEMS.
(B) ENFORCEMENT BY BOARD.
(1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, UNLESS THE BOARD DETERMINES THAT A COUNTY IS
ADEQUATELY ENFORCING THE STATE PLUMBING CODE OR A LOCAL PLUMBING
CODE THAT MEETS OR EXCEEDS THE MINIMUM STANDARDS OF THE STATE
PLUMBING CODE, THE BOARD SHALL ENFORCE THE STATE PLUMBING CODE
THROUGHOUT THE STATE. IN THAT COUNTY.
(2) (C) COOPERATIVE AGREEMENTS.
THE BOARD MAY MAKE A COOPERATIVE AGREEMENT WITH A COUNTY FOR
THE COUNTY TO ENFORCE:
(I) (1) THE STATE PLUMBING CODE; OR
(II) (2) IF THE COUNTY HAS ADOPTED A LOCAL
PLUMBING CODE, THAT CODE.
COMMITTEE COMMENT: Subsection (a) of this section is new
language substituted for the first clause of the
second sentence of former Art. 56, § 444(a), which
allowed, rather than required, a county to adopt a
local plumbing code or to enforce the State Plumbing
Code.
