Subsection (f)(4) of this section is new language
added to provide expressly that the Commission may
elect to take disciplinary action for the grounds
enumerated in this section without using a summary
procedure.

In subsection (g) of this section, the former
reference to an individual who is "registered" is
deleted to avoid an unintended limitation in the
application of this subsection. Even if a developer
fails to comply with the registration requirements of
this title and, therefore, is not registered, the
developer is required to comply with the record
keeping requirements of this subsection.

SECTION 4. AND BE IT FURTHER ENACTED, That the following
provisions relating to the executive director of the Commission,
Section 214(a) of Article 56 - Licenses be and they hereby are
repealed and reenacted, with amendments, and transferred from the
Annotated Code of Maryland to the Session Laws, to read as
follows:

Article 56 - Licenses

[214.]

[(a)] The Commission, subject to the approval of the
Secretary of Licensing and Regulation, shall employ an executive
director [and such assistants as may be necessary and do all
other things deemed necessary to discharge the duties imposed by
and to effect the purposes of this subtitle], who shall serve at
the pleasure of the Commission. [Said persons] THE EXECUTIVE
DIRECTOR may be removed without cause by either the Commission or
the Secretary of Licensing and Regulation, provided that the
Commission shall not remove [said persons] THE EXECUTIVE DIRECTOR
without the approval of the Secretary of Licensing and
Regulation. [For any appointment made on or after July 1, 1983,
the Real Estate Commission shall submit three nominees from whom
the Secretary shall appoint the executive director, who shall
serve at the pleasure of the Secretary.] The executive director
shall possess a broad knowledge of the generally accepted
practices in the real estate business in this State and be
reasonably well informed as to the general laws governing agency
and contracts for the conveyance or leasing of real estate. The
executive director shall devote his entire time to the duties of
his office, and shall not hold any other position or occupation
or engage in any other business interfering with his giving full
attention to the work of his office or which might be
inconsistent with his duties and responsibilities as executive
director to the Commission.
