Also in subsection (d) of this section, the phrase
"prospective buyer or renter" is substituted for the
former reference to "person", for clarity.

Also in subsection (d) of this section, the language
"residential property or prospective site for a
residence" is substituted for the former defined term
"residential property". This language conveys the
substance of the former defined term "residential
property" without the necessity of being defined.

Former Art. 56, § 230E(c)(2), which defined "person",
is deleted as unnecessary in light of the defined term
"person".

Former Art. 56, § 230E(c)(4), which defined "to show"
residential property, is deleted as surplusage.

IN BALTIMORE CITY AND BALTIMORE COUNTY, A REAL ESTATE
BROKER, ASSOCIATE REAL ESTATE BROKER, OR REAL ESTATE SALESPERSON
MAY NOT MASS SOLICIT LISTINGS BY USING THE NAME OR ADDRESS OF A
PRESENT OR PREVIOUS CLIENT WITHOUT THE WRITTEN CONSENT OF BOTH
PARTIES TO THE CONTRACT.

REVISOR'S NOTE: This section is new language added to
prohibit expressly the mass solicitation of listings
in Baltimore City and Baltimore County.

4-601. PROVIDING REAL ESTATE BROKERAGE SERVICES WITHOUT LICENSE.

(A) REAL ESTATE BROKER.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, A PERSON MAY NOT
PROVIDE REAL ESTATE BROKERAGE SERVICES, ATTEMPT TO PROVIDE REAL
ESTATE BROKERAGE SERVICES, OR OFFER TO PROVIDE REAL ESTATE
BROKERAGE SERVICES UNLESS LICENSED BY THE COMMISSION AS A REAL
ESTATE BROKER.
