SUBCOMMITTEE COMMENT: This section is new language derived
without substantive change from the first clause of
former Art. 56, § 217(a), except as it related to
engaging in a business, and the first sentence of §
230(a), except as it related to engaging in a
business.

Throughout this section, the references to "attempt"
and "offer" are added to conform to similar provisions
governing other regulated occupations in the Code.

In subsection (b) of this section, the reference to an
"associate real estate broker" is added in conformity
with provisions added throughout this title to provide
a licensing scheme for associate real estate brokers.
See the General Subcommittee Comment to this title.

The provisions of former Art. 56, §§ 217(a) and 230(a)
that referred to "June 1, 1939" are deleted as
obsolete.

The provisions of former Art. 56, §§ 217(a) and 230(a)
that referred to a "copartnership, association, or
corporation" engaging in the business of a real estate
broker or real estate salesman are deleted as
erroneous. Only an individual, not a business entity,
may be licensed as a real estate broker or a real
estate salesperson.

As to the referenced exceptions, see §§ 4-102,
4-301(b), and 4-302 of this title.
