Commission may not grant the license, is deleted as an
unnecessary statement of the obvious.

Several provisions in the former law were both grounds
for administrative disciplinary action as well as
prohibited acts. Since the former law provided that a
violation of any provision of this title is a ground
for disciplinary action (revised as item (31) of this
section), reference to a violation of each specific
ground that is also a prohibited act is unnecessary in
this section. Several of these duplicative
provisions, therefore, are deleted as unnecessary in
this section. They consist of: the third sentence of
former Art. 56, § 224B, as it related to disciplinary
action on the basis of a violation of the provisions
making it unlawful for a broker to lend a license or
to allow an unlicensed person to operate as a broker;
§ 227(b), which provided that a violation of the
provisions prohibiting payment of compensation to
unauthorized persons, prohibiting certain payments to
lawyers, and prohibiting mass solicitations for
referrals from lawyers a ground for suspension or
revocation of a license; and § 227B(b), which provided
that violation of the section making it unlawful for
any licensee to post certain advertisements concerning
ground rent was a grounds for suspension or revocation
of a license.

The second sentence of former Art. 56, § 224(a), which
provided that a licensee must show cause why the
license should not be suspended or revoked on notice
of a second reprimand, is deleted as nonsensical. In
any case presented to the Commission under this
section, it may choose among several remedies,
including a reprimand of the licensee or the
suspension or revocation of the license of the
licensee. If the Commission determines that the
sanction against a licensee ought to be more than a
reprimand, it simply orders that more severe sanction.
There is no requirement and no reason for the
Commission to first issue a reprimand.
