In item (14) of this section, the last clause of
former Art. 56, § 224(h), which provided that "nothing
in this subsection shall be construed to authorize any
such broker or salesman personally to prepare any such
legal papers", is deleted as unnecessary. Nothing in
the former subsection purported to authorize a real
estate broker, associate real estate broker, or a real
estate salesperson to prepare legal documents. In any
event, the activities limited to lawyers are covered
under Title 10 of the proposed Business Occupations
Article.
In item (16) of this section, the former phrase "in
developed or high density areas as defined by the
Commission" is deleted on the recommendation of the
Joint Subcommittee on the Business Occupations Article
as unnecessary and incapable of definition. The Joint
Subcommittee believed that the activities that item
(16) enumerates are objectionable with regard to any
property.
In item (18) of this section, the defined term "real
estate salesperson" is substituted for the former
references to an "agent", for clarity.
In item (24) of this section, new language is added to
cover situations in which a licensee pleads guilty or
nolo contendere to an offense or receives probation
before judgment with respect to ah offense. This new
language is added on the recommendation of the Joint
Subcommittee on the Business Occupations Article and
conforms closely to comparable provisions in other
titles in this article.
In item (24)(iii) of this section, the language of
former Art. 56, § 217(d) that provided that the
Commission may refuse to issue a license to a person
convicted of a crime that constitutes a violation of
any provisions of the title is revised as a ground for
disciplinary action.
In item (25) of this section, the former phrase
"whether of the same or a different character than
hereinabove specified" is deleted as surplusage.
In item (26) of this section} the phrase "in a
transaction or practice" is added for clarity on the
recommendation of the Joint Subcommittee on the
Business Occupations Article.
The first sentence of former Art. 56, § 225(c), which
provided that if the Commission determines an
applicant is not qualified to receive a license, the
