4-212. MISCELLANEOUS POWERS AND DUTIES.
IN ADDITION TO ANY POWERS AND DUTIES SET FORTH ELSEWHERE,
THE COMMISSION HAS THE FOLLOWING POWERS AND DUTIES:
(1) TO ADOPT A SEAL;
(2) TO USE THE SEAL TO AUTHENTICATE ITS PROCEEDINGS;
(3) TO DETERMINE THE SIZE AND FORM OF LICENSE
CERTIFICATES AND POCKET CARDS; AND
(4) TO APPROVE EDUCATIONAL COURSES.
SUBCOMMITTEE COMMENT: This section is new language derived
without substantive change from the first sentence of
former Art. 56, § 215(b), § 221(c), as that subsection
related to the size and form of license certificates
and pocket cards, and § 226(a), as that subsection
related to educational material.
In item (4) of this section, the reference to
educational "courses" is substituted for the former
reference to educational "material", for clarity.
Also in item (4) of this section, the former
requirement that the Commission mail any educational
material approved by the Commission to each licensee
and make the material available to any other person on
request is deleted as obsolete. The former
requirement was applicable before the establishment of
a continuing educational program under this title.
The second and third sentences of former Art. 56, §
215(b), which provided that copies of records of the
Commission may be received in evidence like originals
and that records of the Commission are open to public
inspection, are deleted as unnecessary. The
admissibility of public records is governed by CJ §
10-204. Inspection of public records is governed by
the general provisions concerning access to public
records in SG §§ 10-611 to 10-628.
