EXCEPT AS OTHERWISE PROVIDED BY LAW, THE COMMISSION SHALL
PAY ALL MONEY COLLECTED UNDER THIS TITLE INTO THE GENERAL FUND OF
THE STATE.
SUBCOMMITTEE COMMENT: This section is new language derived
without substantive change from the first sentence of
former Art. 56, § 216(a).
The introductory clause of this section, "[e]xcept as
otherwise provided by law", is added in light of the
provisions for the Licensing Testing Fund under Art.
41, § 8-104(g).
The reference to payment "into the General Fund" is
substituted for the former reference to deposit "to
the credit of the State Treasurer in such bank ... or
trust companies", for brevity and clarity.
The former reference to all fees being paid to the
Commission is deleted as an unnecessary statement of
the obvious.
The second sentence of former Art. 56, § 216(a), which
provided for the disbursement of appropriations in the
State budget for expenses of the Commission, is
deleted as unnecessary and potentially misleading.
The disbursement of money for all of the boards and
commissions in the Department is made under the budget
and through the Department. The procedure for these
disbursements is uniform for all of the boards and
commissions.
Similarly, former Art. 56, § 216(b), which required
the executive director to keep books of account, is
deleted as obsolete. Since all money received is paid
into the General Fund and all funding is through the
Department, the Commission no longer keeps books of
accounts of receipts and expenditures.
