(C) DISTRIBUTION.
THE COMMISSION:

(1)  AT LEAST ONCE EVERY 2 YEARS, SHALL PROVIDE A COPY
OF THE REGULATIONS ADOPTED UNDER THIS TITLE TO EACH LICENSEE; AND

(2)  ON REQUEST OF ANY PERSON, SHALL MAKE AVAILABLE A
COPY OF THE REGULATIONS TO THAT PERSON.

SUBCOMMITTEE COMMENT: This section is new language derived
without substantive change from the second clause of
the third sentence of former Art. 56, § 217(c)(2), the
second clause of § 229, the third sentence of § 220,
as that sentence related to adoption of regulations,
and § 226(a), as that subsection related to copies of
regulations.

In subsection (a)(1) of this section, the reference to
"bylaws" for the conduct of its "proceedings" is
substituted for the former reference to "rules and
regulations" for the conduct of its "business".
Throughout the Health Occupations Article and the
proposed Business Occupations Article, the power to
adopt regulations for the conduct of a unit's
proceedings is expressed in terms of the adoption of
bylaws.

In subsection (c)(1) of this section, the phrase "at
least once every 2 years" is added on the
recommendation of the Joint Subcommittee on the
Business Occupations Article to specify a time frame
within which the Commission is required to provide
regulations to licensees. Updates to regulations are
available in the Maryland Register at other times.

Also in subsection (c)(1) of this section, the
language "shall provide a copy of the regulations ...
to each licensee" is substituted for the language in
former Art. 56, § 226(a) "[a] copy of any rules or
regulations ... shall be mailed by the Commission to
all licensees". To reduce the expense, the practice
of the Commission has been to provide copies of the
regulations to real estate brokers who then distribute
the copies to the associate real estate brokers and
real estate salespersons who are affiliated with the
broker. In light of the limited resources available
to the Commission, the Joint Subcommittee on the
Business Occupations Article recommended that the
former requirement for individual mailings be deleted.
