function of setting "standards of conduct" for
licensees.

Subsection (b) of this section is new language derived
without substantive change from former. Art. 56, §
226(a), as it related to the Code of Ethics.

In subsection (b)(1) of this section,: the phrase "at
least once every 2 years" is added on the
recommendation of the Joint Subcommittee on the
Business Occupations Article to specify a time frame
within which the Commission is required to provide the
Code Of Ethics to licensees.

Also in subsection (b)(1) of this section,, the duty to
"provide" a copy of the Code of Ethics to each
licensee is substituted for the former duty that a
copy "be mailed". In practice, to lessen the expense,
the Commission provides copies of the Code Of Ethics
to real estate brokers who then distribute the copies
to the associate real estate brokers and real estate
salespersons who are affiliated with the broker. In
light of the limited resources available to the
Commission, the Joint Subcommittee on the Business
Occupations' Article recommended that the former
requirement for individual mailings be deleted.

4-208. REGULATIONS.

(A) POWER TO ADOPT REGULATIONS AND BYLAWS.

THE COMMISSION MAY ADOPT:

(1) REASONABLE BYLAWS FOR THE CONDUCT OF ITS
PROCEEDINGS;

(2) REASONABLE REGULATIONS FOR THE CONDUCT OF

HEARINGS;

(3)  REASONABLE REGULATIONS TO GOVERN APPLICATIONS FOR
LICENSES; AND

(4)  SUBJECT TO SUBSECTION (B) OF THIS SECTION,
REASONABLE REGULATIONS TO CARRY OUT THIS TITLE.

(B) LIMITS ON RULEMAKING POWER.

THE COMMISSION MAY NOT ADOPT A REGULATION THAT WOULD ALLOW
FOR THE ISSUANCE OF A CONDITIONAL OR TEMPORARY LICENSE.
