combination of drugs, or a combination of one or more drugs and
alcohol that he cannot drive a vehicle safely.

(2) It is not a defense to any charge of violating
this subsection that the person charged is or was entitled under
the laws of this State to use the drug, combination of drugs, or
combination of one or more drugs and alcohol, unless the person
was unaware that the drug or combination would make him incapable
of safely driving a vehicle.

(d) A person may not drive or attempt to drive any vehicle
while he is under the influence of any controlled dangerous
substance, as that term is defined in Article 27, § 279 of the
Code, if the person is not entitled to use the controlled
dangerous substance under the laws of this State.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.

(Senate Bill 201)

AN ACT concerning

Real Estate Brokers

FOR the purpose of revising, through both substantive and
nonsubstantive changes, the laws of the State that regulate
real estate brokers and the provision of real estate
brokerage services including: the resolution of conflicting
provisions in the current law by clearly providing that only
an individual may qualify for a real estate broker license;
the specification of the right of a licensed real estate
broker to provide services through a corporation or
partnership; the addition of express provisions that provide
for the licensing of associate real estate brokers; the
addition of express provisions requiring that an individual
be affiliated with a licensed real estate broker before the
Real Estate Commission may issue an associate real estate
broker license or a real estate salesperson license to the
individual; the broadening of the enforcement powers of the
Commission; the addition of express procedures for the
transferring of a real estate salesperson or associate real
estate broker from one real estate broker to another; the
addition of express procedures for an individual who holds
one type of license to exchange it for another; the addition
