staff of the University of Maryland System. In implementing the
consolidation of the staffs, the Board of Regents may not
increase during fiscal 1989 the salaries of individuals who
served in administrative positions on the Board of Trustees
beyond the level of salaries authorized in the fiscal year 1989
budget, including the cost of living adjustment and any annual
salary review.

SECTION 6. AND BE IT FURTHER ENACTED, That every person
who, as of June 30, 1988, is employed on the staff of the State
Board for Higher Education or the State Scholarship Board,
including the Executive Director of the State Scholarship Board,
in a position authorized by the State budget, is hereby
transferred to the staff of the Maryland Higher Education
Commission, effective July 1, 1988, unless and until the Maryland
Higher Education Commission eliminates such position. The
Maryland Higher Education Commission shall examine the positions
on the staff of the Commission and shall take action, not later
than October 1, December 31, 1988, either to approve, eliminate,
or modify each position. The salaries of individuals employed on
the staff of the State Board of Higher Education and the State
Scholarship board may not be increased during fiscal year 1989
beyond the level of salaries authorized in the fiscal year 1989
budget, including the cost of living adjustment and any annual
salary review or an adjustment for a classified position in
salary grade 21 or below pursuant to rules and regulations of the
Department of Personnel. The salary of the acting Secretary of
Higher Educatin Education shall be the salary as authorized for
the Commissioner or of Higher Education during fiscal year 1989.
The salary of the Secretary of Higher Education shall be
submitted to and approved by the Legislative Policy Committee
prior to recruiting for the position. This Act may not be
construed to affect the retirement status of any person who, as
of June 30, 1988, is employed by the State Board for
Higher
Education or the State Scholarship Board and who is transferred
to the staff of the Maryland Higher Education C
ommission.

SECTION 7. AND BE IT FURTHER ENACTED, That every person in
a clerical position who, as of June 30, 1988, is employed by the
University of Maryland, the Board of Trustees of State
Universities and Colleges, the State Board for Higher Education,
or the State Scholarship Board and is affected by a geographic
relocation under this Act, shall be given the option, to the
extent possible, of transferring to another position in State
service in the same geographic area of current employment without
any change or loss of rights, benefits, or entitlements,
including, if any, retirement status, except as otherwise
specifically provided in this Act. Every person who, as of June
30, 1988, is a classified employee of the University of Maryland,
the Board of Trustees of State Universities and Colleges, or an
institution formerly under its jurisdiction is hereby transferred
