WILLIAM DONALD SCHAEFER, Governor                   Ch. 162

(3) "WARD OR CHARGE OF THE STATE" MEANS A PRISONER,
PATIENT, CLIENT, OR OTHER WHO IS IN THE CARE OR CUSTODY OF THE
STATE OR ANY AGENCY OF THE STATE.

(B)  (1) SUBJECT TO THE REQUIREMENTS OF SUBSECTION (C) OF
THIS SECTION, WHENEVER AN EMPLOYEE, WHILE IN THE ACTUAL
PERFORMANCE OF JOB DUTIES, SUSTAINS DAMAGE OR DESTRUCTION OF THE
EMPLOYEE'S PERSONAL PROPERTY, AS A RESULT OF THE INTENTIONAL ACT
OF A WARD OR CHARGE OF THE STATE, TO THE EXTENT THAT THE EMPLOYEE
IS NOT REIMBURSED PURSUANT TO OTHER PROVISIONS OF THE CODE, THE
AGENCY FOR WHOM THE EMPLOYEE WORKS SHALL REIMBURSE THE EMPLOYEE
FOR THE ACTUAL AMOUNT OF LOSS THAT EXCEEDS $20.

(2) THE REIMBURSEMENT UNDER THIS SECTION FOR ANY ITEM
OF PERSONAL PROPERTY MAY NOT EXCEED $100. THIS REIMBURSEMENT SHALL
BE SUBJECT TO REASONABLE. VERIFICATION OF WE VALUE OF THE
PROPERTY AT THE TIME OF THE LOSS.

(C)  AN EMPLOYEE SHALL REPORT THE DAMAGE OR DESTRUCTION OF
PERSONAL PROPERTY AND THE ESTIMATED AMOUNT OF LOSS TO THE
EMPLOYEE'S IMMEDIATE SUPERVISOR IN WRITING NO LATER THAN THE
CLOSE OF BUSINESS OF THE NEXT WORKING DAY FOR THE EMPLOYEE.

(D) THE SECRETARY OF PERSONNEL SHALL ADOPT REGULATIONS TO
CARRY OUT THE PROVISION OF THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.

(House Bill 35)

AN ACT concerning

Smoke Detectors - Deaf or Hearing Impaired

FOR the purpose of altering the type of smoke detector a landlord
is required to provide a deaf or hearing impaired occupant;
providing that the smoke detector be approved by certain
testing laboratories; and generally relating to smoke"
detectors for deaf or hearing impaired persons.

BY repealing and reenacting, with amendments,
