Ch. 48

(B) IN GENERAL.

(1) A BUSINESS IS DEBARRED FROM ENTERING INTO A
CONTRACT WITH A PUBLIC BODY IF THE BOARD DEBARS:

(I) AN OFFICER, DIRECTOR, OR PARTNER OF THE

BUSINESS; OR

(II) AN EMPLOYEE OF THE BUSINESS DIRECTLY
INVOLVED IN OBTAINING CONTRACTS WITH PUBLIC BODIES.

SECTION:

(2) A BUSINESS SHALL REMAIN DEBARRED UNDER THIS

(I) AS LONG AS THE INDIVIDUAL WHO IS DEBARRED
REMAINS WITH THE BUSINESS IN ANY CAPACITY DESCRIBED IN PARAGRAPH
(1)(I) OR (II) OF THIS SUBSECTION; OR

(II) UNTIL THE DEBARMENT IS REMOVED UNDER §
16-207 OF THIS SUBTITLE.

(C) NOTICE TO BUSINESS.

THE BOARD SHALL NOTIFY IN WRITING ANY BUSINESS THAT IS
DEBARRED UNDER THIS SECTION.

REVISOR'S NOTE: Subsections (a), (b)(1) and (2)(i), and (c)

of this section are new language derived without

substantive change from former SF §§ 12-101(b) and
12-108.

Subsection (b)(2)(ii) of this section is new language

added to state expressly that which only was implied

by the provision of the former law that a person who
is debarred may be reinstated.

In subsection (b)(2)(i) of this section, the words "in
a capacity described in paragraph (l)(i) or (ii) of
this subsection" are substituted for the former
ambiguous phase "in any such capacity", to clarify the
position a debarred person could hold that would cause
a business to remain debarred.
