(III)  WHETHER AND TO WHAT EXTENT THE PERSON
COOPERATED WITH AUTHORITIES IN THEIR INVESTIGATION OF THE MATTER;
AND

(IV)  THE CONDITIONS UNDER WHICH THE PERSON
COOPERATED;

(2)  CONSIDER THE CONDUCT OF THE PERSON SINCE THE ACT
OCCURRED; AND

(3)  CONCLUDE WHETHER THE INTEGRITY OF THE CONTRACTING
PROCESS AND THE BEST INTERESTS OF THE STATE WOULD BE SERVED BY
DEBARRING THE PERSON FROM ENTERING INTO CONTRACTS WITH PUBLIC
BODIES.

(E) NOTICE OF RESULTS.

ON MAKING ITS DETERMINATION, THE BOARD SHALL GIVE WRITTEN
NOTICE TO THE PERSON SUBJECT TO DEBARMENT THAT THE PERSON:

(1)  IS DEBARRED; OR

(2)  IS NO LONGER SUBJECT TO DEBARMENT FOR THE ACTS
THAT WERE THE SUBJECT OF THE HEARING AND DETERMINATION.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF §§ 12-104
and 12-106.

In subsection (b)(2) of this section, the former
reference to extension of the time for "determination"
is deleted as surplusage, since no time limit is set
for that purpose.

In subsection (d)(3) of this section, the defined term
"public bod[ies]" is substituted for the former
reference to "governmental entities within the State",
since the Board may debar a person only with respect
to public bodies.

16-206. BUSINESSES EMPLOYING DEBARRED PERSONS.

(A) "BUSINESS" DEFINED.

IN THIS SECTION, "BUSINESS" MEANS AN INDIVIDUAL OR A
CORPORATION, PARTNERSHIP, SOLE PROPRIETORSHIP, JOINT VENTURE, OR
OTHER LEGAL ENTITY THROUGH WHICH COMMERCIAL ACTIVITY IS
CONDUCTED.
