Ch. 48

LAWS OF MARYLAND

(1)  IF THE CONVICTION THAT IS THE BASIS FOR A
DEBARMENT IS REVERSED OR OTHERWISE RENDERED VOID, THE DEBARMENT
TERMINATES AUTOMATICALLY.

(2)  IN ANY OTHER CASE, AFTER A PERIOD OF 5 YEARS
AFTER THE DATE OF DEBARMENT UNDER THIS SUBTITLE, THE PERSON
DEBARRED MAY PETITION THE BOARD TO REMOVE THE DEBARMENT.

(B)  TIME FOR HEARING.

(1)  EXCEPT AS PROVIDED UNDER PARAGRAPH (2) OF THIS
SUBSECTION, WITHIN 90 DAYS AFTER RECEIVING A PETITION UNDER
SUBSECTION (A)(2) OF THIS SECTION, THE BOARD OR A HEARING
EXAMINER APPOINTED BY THE BOARD SHALL CONDUCT A HEARING TO
DETERMINE WHETHER THE DEBARMENT SHOULD BE REMOVED.

(2)  FOR GOOD CAUSE, THE BOARD MAY EXTEND THE TIME FOR
A HEARING.

(C)  DETERMINATION.

IN MAKING A DETERMINATION, THE BOARD SHALL:

(1)  CONSIDER EACH FACTOR SET FORTH IN § 16-205(D)(1)
AND (2) OF THIS SUBTITLE; AND

(2)  CONCLUDE WHETHER THE INTEGRITY OF THE CONTRACTING
PROCESS AND THE BEST INTERESTS OF THE STATE WOULD BE SERVED BY
CONTINUING THE DEBARMENT.

(D)  NOTICE OF RESULTS.

ON MAKING ITS DETERMINATION, THE BOARD SHALL GIVE WRITTEN
NOTICE TO THE PETITIONER THAT THE DEBARMENT HAS BEEN REMOVED OR
WILL CONTINUE.

16-208. PROHIBITED CONTRACTS.

A PUBLIC BODY MAY NOT KNOWINGLY ENTER INTO A CONTRACT UNDER
WHICH A PERSON DEBARRED UNDER THIS SUBTITLE WILL PROVIDE TO A
PUBLIC BODY, DIRECTLY OR INDIRECTLY, SUPPLIES, SERVICES,
ARCHITECTURAL SERVICES, ENGINEERING SERVICES, CONSTRUCTION
RELATED SERVICES, SUPPLIES, SERVICES LEASES OF REAL PROPERTY, OR
CONSTRUCTION.
