REVISOR'S NOTE: This subsection is new language derived
without substantive change from former SF §
ll-141(b)(l) and (2).
This subsection is revised to incorporate the
definition of "handicapped", which the former law set
out as a separate defined term, since the word
"handicapped" appeared only in the definition of
"sheltered workshop" and in former SF § ll-141(a),
which stated that supplies and services of the
"handicapped" shall be purchased in accordance with
this "section". That "section" related only to
sheltered workshops.
In item (1) of this subsection, the word "or" is
substituted for the former word "and" to reflect that
an entity is organized under either federal or State
law, not both.
In item (4)(ii) of this subsection, the words "is of
such a nature as to", which formerly modified the word
"prevent[s]", are deleted as surplusage.
Also in item (4)(ii) of this subsection, the word
"currently", which formerly modified the word
"engaging", is deleted as surplusage.
(C) STATE AIDED OR CONTROLLED ENTITY.
"STATE AIDED OR CONTROLLED ENTITY" MEANS:
(1) A UNIT OF THE STATE GOVERNMENT; AND
(2) ANY PUBLIC OR QUASI-PUBLIC INSTITUTION THAT
RECEIVES AID FROM THE STATE OR THAT IS OWNED, CONTROLLED, OR
MANAGED BY THE STATE.
REVISOR'S NOTE: This subsection is new language added to
avoid repetition of the former words "all State-aided,
owned, controlled, or managed public or quasi-public
institutions and agencies".
14-102. EFFECT OF SUBTITLE.
NOTWITHSTANDING ANY OTHER PROVISION OF THIS DIVISION II, THE
STATE SHALL BUY SUPPLIES AND SERVICES IN ACCORDANCE WITH THIS
SUBTITLE.
