LAWS OF MARYLAND

THIS SUBTITLE MAY BE CITED AS " THE "MARYLAND ARCHITECTURAL
AND ENGINEERING SERVICES ACT".

REVISOR'S NOTE: This section is new language substituted
for former SF §§ 11-166 and 11-184, which provided for
joint and several citation of the provisions that
relate to transportation units and other units, to
reflect the revisions of those provisions together in
this subtitle.

TITLE 14. PREFERENCES.

SUBTITLE 1. PREFERENCES TO BENEFIT DISADVANTAGED
INDIVIDUALS.

14-101. DEFINITIONS.

(A)  IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language added as
the standard introductory language to a definition
section.

(B)  SHELTERED WORKSHOP.

"SHELTERED WORKSHOP" MEANS AN AGENCY THE NET INCOME OF WHICH
DOES NOT INURE WHOLLY OR PARTLY TO THE BENEFIT OF ANY SHAREHOLDER
OR OTHER INDIVIDUAL AND THAT IS:

(1)  THAT IS ORGANIZED UNDER THE LAWS OF THE UNITED
STATES OR THE STATE;

(2)  THAT IS CERTIFIED AS A SHELTERED WORKSHOP BY THE
WAGE AND HOUR DIVISION OF THE UNITED STATES DEPARTMENT OF LABOR;

(3)  THAT IS ACCREDITED BY THE DIVISION OF VOCATIONAL
REHABILITATION OF THE STATE DEPARTMENT OF EDUCATION; AND

(4)  THAT IS OPERATED IN THE INTEREST OF INDIVIDUALS
WHO HAVE A MENTAL OR PHYSICAL DISABILITY, INCLUDING BLINDNESS,
THAT:

(I)  CONSTITUTES A SUBSTANTIAL HANDICAP TO
EMPLOYMENT; AND

(II)  PREVENTS THE INDIVIDUAL FROM ENGAGING IN
NORMAL COMPETITIVE EMPLOYMENT . ; AND

(5)  THE NET INCOME OF WHICH DOES NOT INURE WHOLLY OR
PARTLY TO THE BENEFIT OF ANY SHAREHOLDER OR OTHER INDIVIDUAL.
