Subsection (b)(1) of this section is revised to
clarify that the former term "insurance and banking
and financial services" included "insurance" and
"insurance services".
In subsection (b)(2)(ii) of this section, the
reference to "Division II" is substituted for the
former reference to "this subtitle" to reflect the
reorganization of this revised Division. The
substituted language is broader since this Division
contains provisions from former Title 11, Subtitle 2
and Title 12. At the same time, provisions that
appeared in former Title 11, Subtitle 1 now are
contained in new titles that correspond to distinct
areas of the procurement laws.
In subsection (b)(2)(iii), (3)(ii), and (5)(i) of this
section, the term "motor vehicles" is substituted for
the former word "automobiles" to conform to the
language in Title 3, Subtitle 5 of this article. The
substitution in subsection (b)(3)(ii) of this section
also reflects practice.
In subsection (b)(3)(v) and (4)(iii) of this section,
the word "or" is substituted for the former word "and"
since it did not seem to be the intent of the General
Assembly to confer authority only when both
"architectural and engineering services" were
involved.
Also in subsection (b)(3)(v) and (4)(iii) of this
section, the reference to "Title 13, Subtitle 3 of
this article" is substituted for the former references
to "Part XV of this subtitle" and "Part XIV of this
subtitle". The referenced parts have been revised
together in Title 13, Subtitle 3 of this article.
The Procurement Revision Review Committee notes, for
consideration by the General Assembly, that the term
"motor vehicle" has a broader meaning than the word
"automobile". The references, in Title 3, Subtitle 5
of this article, to "motor vehicle" were derived from
former Art. 15A, § 23A(a) and (c), which granted the
Secretary of Budget and Fiscal Planning the authority
to purchase "motor vehicles". But former SF §
ll-105(d), in referring to that authority, used the
word "automobile".
The Procurement Revision Review Committee also notes
that this section authorizes the Department of
Transportation, the Maryland Transportation Authority
and the University of Maryland to engage in
