12-108. REGULATIONS OF PRIMARY PROCUREMENT UNITS.

(A)  SCOPE OF SECTION.

THIS SECTION DOES NOT APPLY TO CAPITAL EXPENDITURES BY THE
DEPARTMENT OF TRANSPORTATION OR THE MARYLAND TRANSPORTATION
AUTHORITY, IN CONNECTION WITH STATE ROADS, BRIDGES, OR HIGHWAYS,
AS PROVIDED IN § 12-202 OF THIS TITLE.

(B)  REQUIREMENTS.

SUBJECT TO § 12-104 OF THIS SUBTITLE THE APPROVAL OF THE
BOARD AND UNDER THE COORDINATION OF THE GOVERNOR, EACH OF THE
PRIMARY PROCUREMENT UNITS SHALL:

(1)  ADOPT REGULATIONS TO CARRY OUT THIS DIVISION II;

(2)  SEND TO THE BOARD A COPY OF EACH PROPOSED
REGULATION UNDER ITEM (1) OF THIS SECTION; AND

(3)  SEND TO THE BOARD A COPY OF EACH INTERNAL
OPERATING PROCEDURE THAT THE PRIMARY PROCUREMENT UNIT ADOPTS.

REVISOR'S NOTE: Subsections (a) and (b)(1) and (3) of this
section are new language derived without substantive
change from former SF § ll-105(a) and (e).

Subsection (b)(2) of this section is new language
added to reflect practice and to conform to §
12-101(b)(3) of this subtitle. The Procurement
Revision Review Committee calls this addition to the
attention of the General Assembly.
