LAWS OF MARYLAND
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That § 4-301(d) and, in its entirety, Division II of
the State Finance and Procurement Article of the Annotated Code
of Maryland be repealed.
SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:
Article - State Finance and Procurement
4-304.
(a) The Secretary or any employee of the Department may
not:
(1) be interested in any contract or bid for
furnishing any supplies to any [using agency] UNIT THAT PROCURES
SUPPLIES UNDER DIVISION II OF THIS ARTICLE;
(2) be connected in any manner, directly or
indirectly, with any contract or bid for furnishing any supplies
to any [using agency] OF THOSE UNITS; or
REVISOR'S NOTE: Ch. ___, Acts of 1988, which enacted
Division II of this article, amended subsection (a)(1)
and (2) of this section to substitute the words "unit
that procures supplies under Division II of this
article" for the former term "using agency" to conform
to the language used in Division II. The former term
"using agency", as defined in § 4-301(d) of this
subtitle, incorporated, by reference, the definition
in former SF § ll-101(t). However, Ch. 840, Acts of
1986, deleted that definition. The substitution is
consistent with the definition of "using agency",
defined prior to Ch. 840, Acts of 1986 to mean "any
State agency which uses any supplies, services, or
construction procured under this Division II of this
article." The substituted language does not include
the former reference to "any ... services or
construction", because this subtitle governs the
procurement of "supplies" and, therefore, a reference
to "services or construction" would be inaccurate.

(a) The Secretary shall adopt standards for maintaining
stores and inventory control for all supplies required by any
[using agency] UNIT THAT PROCURES SUPPLIES UNDER DIVISION II OF
THIS ARTICLE.
(b) (1) To the extent required by the Secretary, each
[using agency] UNIT THAT PROCURES SUPPLIES UNDER DIVISION II OF
