AN ACT:

Chapter 32

Laws of Montgomery County, 1987

(1)  to clarify election procedures in homeowners'
associations:

(A)  to require that, [[60]] not less than 10 nor
more than 90 days before an election,
members of a homeowners' association must
receive notice of the election and the
procedures that will be followed;

(B)  to provide that a proxy vote for an election
for the governing body must be directed;

(C)  to prohibit cumulative voting;

(D)  to prohibit opening or counting ballots
until the polls are closed;

(E)  to provide that unless the association's
documents provide for terms of office, the
term for a member of the governing body is
[[3]] 2 years and all terms are staggered;

(2)  [[to require homeowners' associations to have
adequate insurance for members of their governing
body and officers;

(3)]] to provide that unless the association's
documents provide otherwise, the homeowners'
association must prepare an annual budget and
circulate it to members for comment at least 30
days before adopting the budget;

[[(4) to require the County Executive to adopt
regulations regarding the insurance
